Section 504 of the Rehabilitation Act of 1973 & Title II of the Americans with Disabilities Act
Section 504 of the Rehabilitation Act of 1973 and Title II of the Americans with Disabilities Act are federal civil rights laws that prohibits discrimination against individuals with disabilities.
The intent of these law is to provide students with disabilities equal access to educational programs, services, and activities. Students with disabilities may not be denied participation in school programs and activities solely on the basis of disability.
The District is required to ensure that students and other individuals with disabilities, including parents, are not denied access to programs or activities because of inaccessible facilities, including school buildings, walkways, restrooms, playgrounds, and parking spaces. Additionally, Section 504 of the Rehabilitation Act of 1973 and Title II of the Americans with Disabilities Act provide individuals with disabilities the equal opportunity to participate in and enjoy the benefits of the school's services, programs, and activities, including possible provision of auxiliary aids and services where necessary to afford disabled individuals such access. This includes ensuring effective communication with individuals who have hearing, vision, or speech disabilities, and making reasonable modifications to policies, practices, and procedures to avoid discrimination unless doing so would fundamentally alter the nature of the service, program, or activity.
